- Mediation Terms and Conditions
- Purpose and Scope of Mediation
- This is a therapeutic mediation process, which combines traditional mediation with trauma-informed, psychoeducational support to facilitate meaningful, emotionally safe communication.
- The mediator facilitates constructive dialogue to help participants reach mutually acceptable agreements, while also supporting emotional regulation and interpersonal skill-building.
- Mediation is a voluntary, confidential process. Either party may withdraw at any time.
- The mediator does not provide legal advice or therapy, but may use therapeutic tools and techniques to support the mediation process.
- Neutrality and Impartiality
- The mediator remains neutral and does not advocate for, diagnose, or take sides with either party.
- Allegations that neutrality constitutes harm will be addressed through clarification. Continued insistence on partiality may result in termination of the mediation process.
- Conduct During Sessions
- Parties agree to conduct themselves respectfully and to listen actively without dominating or interrupting.
- Aggressive behavior, emotional outbursts, or controlling tactics are not permitted.
- The mediator reserves the right to pause or end a session if conduct compromises the process or psychological safety of those present.
- Psychological and Emotional Disclosures
- Participants may name emotional challenges but must not use psychological labels (e.g., trauma, PTSD, etc.) to assert authority or control the process.
- The mediator is trained in trauma-informed care and may support emotional containment, but does not provide clinical mental health diagnosis or treatment.
- When emotional dysregulation interferes with the process, the mediator may recommend individual support or refer the party to an appropriate professional.
- Safety and Emotional Boundaries
- “Safety” is defined as physical or emotional harm that is imminent and significant.
- Feeling discomfort, challenged, or emotionally activated is not in itself unsafe.
- Misuse of safety language to control the dialogue or silence others may lead to termination of the session.
- Confidentiality
- Mediation is confidential, including both joint and individual sessions, except where disclosure is required by law.
- The mediator may not be subpoenaed to testify in court regarding what was said in mediation.
- No session may be recorded without written agreement from both parties and the mediator.

- Long emotional emails or attempts to process outside of scheduled time will not be responded to.

- Address personal regulation or resourcing needs

- Teach Nonviolent Communication (NVC) or other skills to improve future sessions
- These sessions are not therapy. They are psychoeducational, regulatory, and skills-based.

- Content from individual sessions is confidential and will not be shared with the other party unless consent is given, or unless there is risk of serious harm.
- As part of the therapeutic mediation model, the mediator may meet with each party individually to:
- Trauma-Informed Check-Ins
- The mediator may offer short solo check-ins or debriefs to help contain emotions, clarify processes, or manage expectations.
- These check-ins are optional, limited in time, and do not involve processing grievances about the other party outside of mediation structure.
- Repeated misuse of check-ins to bypass mediation agreements or assert influence will result in them being discontinued.
- Mediator Authority
- The mediator has full discretion to manage time, communication structure, and pacing of sessions to ensure psychological safety and progress.
- These check-ins are optional, limited in time, and do not involve processing grievances about the other party outside of mediation structure.
- Mediation may be suspended or terminated if the process becomes destructive, coercive, or no longer productive.
- Purpose and Scope of Mediation

The purpose of couples therapy is to support two individuals in exploring, understanding, and improving their relationship. The practitioner facilitates this process through evidence-based frameworks that may include psychotherapeutic, psychoeducational, and coaching-based methods.
- The Practitioner’s Role
The practitioner’s role is to:
- Provide a safe, structured, and supportive environment for both partners.
- Facilitate communication, insight, and growth.
- Offer tools and education for emotional regulation, needs awareness, and relational repair.
The practitioner does not act as a legal advisor, mediator, or arbitrator, and does not guarantee reconciliation or separation outcomes.
- Structure and Format
- Sessions typically include both joint and individual sessions with each partner.
- Individual sessions allow each partner to explore personal patterns, triggers, and trauma responses that may affect the relationship.
- The inclusion of individual sessions forms part of the standard couples therapy framework and is not considered a separate or secret process.
- The frequency and format of sessions are agreed at the start and may be adjusted based on therapeutic need
- Confidentiality
- Confidentiality is maintained in accordance with professional ethical standards.
- Information disclosed by one partner individually is not shared with the other without explicit consent, except when required by law or when there is risk of serious harm.
- The practitioner reserves the right to break confidentiality if:
- There is risk of harm to self, others, or a child.
- There are safeguarding or child-protection concerns.
- Disclosure is legally mandated (e.g., by court order).
- In the event that confidentiality must be broken, the practitioner will, wherever possible, inform the client(s) before doing so.
- Ethical Boundaries and Neutrality
- The practitioner will act with fairness and impartiality while the couples framework is active.
- If the relationship dissolves and one partner continues individually, the joint work is deemed formally concluded.
- The practitioner will not continue working with both partners separately in an ongoing capacity to avoid conflicts of interest.
- Ethical Boundaries and Neutrality
Once joint couples work formally concludes, any ongoing individual work shall be governed by a separate practitioner-client relationship and separate confidentiality obligations.
Naked Recovery reserves the right to decline ongoing work with either party where conflicts of interest, ethical concerns, or clinical considerations arise.
- Safeguarding and Duty of Care
- The practitioner holds a duty of care to all parties and to any children impacted by the process.

- The program can be paused or terminated with one month’s written notice by either party.
- Refunds are not provided for unused sessions, except in cases of practitioner illness or emergency.
- Professional Conduct and Communication
- Both partners agree to engage respectfully and refrain from hostile, aggressive, or abusive communication towards each other or the practitioner.
- The practitioner reserves the right to pause or terminate the program if communication becomes hostile, unsafe, or ethically inappropriate.
- Contact outside sessions should be limited to logistical or wellbeing matters via email, WhatsApp, or other agreed channels.
- Dual Relationships and Conflicts of Interest
- The practitioner will not engage in any dual or conflicting roles with either party (e.g., legal advisor, mediator, or friend).
- Once the couple’s work concludes, the practitioner will not take on the other partner as an individual client without express consent and ethical review.
- Scope of Practice
- The practitioner operates within a coaching psychology and trauma-informed coaching framework, not as a psychiatrist or medical doctor.

- Early Termination
-
In exceptional circumstances, such as illness or unavailability due to bereavement or other commitments, inappropriate behaviour or a lack of commitment by the client, actual or potential conflict of interest, or other reasons, Naked Recovery can decide to terminate the service to the client early or refuse or be unable to provide further trauma coaching sessions to the client. In such a circumstance the client will be given reasonable notice of termination by Naked Recovery or the assigned Trauma Angel where practicable. If a coaching package was provided at reduced rates, Naked Recovery reserves the right to convert the coaching already provided pro-rata at standard hourly rates and issue a refund less the hours spent on coaching to reflect the total value the Naked Recovery Angels spend on the coaching. Refunds will be given less an administration fee of between 5–15% which covers the Paypal processing fee as well as the administrative fee of processing the refund. No adjustments will be made in changes to foreign exchange rates.
-
The client is entitled to terminate the service early at any time by giving written notice by email or letter. Such notice will take immediate effect as soon as it is received by Naked Recovery or the assigned Trauma Angel. In such a circumstance the client will be entitled to a full refund for any standard coaching sessions already paid for but not yet provided to the client. If a coaching package has been provided at a discount whereby standard coaching rates have been discounted, Naked Recovery reserves the right to convert the coaching already provided pro rata at standard hourly rates and issue a refund less the hours spent on coaching to reflect the total value the Naked Recovery Angels spend on the coaching.

This is particularly important within mediation where couples had a tumultuous marriage where their individual needs were often at war with each other, but believe they can have an amicable divorce or separation. Honesty is important so the Mediator is aware of challenges and can assess whether mediation is suitable. The principles of successful mediation are as follows:
- Voluntary Participation: Both parties willingly engage in the process, understanding that participation is a choice, not an obligation. If either party tries to force the other party to participate or mandates participation, mediation will likely fail.
- Mutual Respect: Each person’s voice, experiences, and boundaries are acknowledged and treated with dignity, even in disagreement.
Emotional Safety: The environment supports emotional expression without fear of retaliation, judgment, or coercion.
- Full Disclosure and Client Responsibility
- Self-Determination: Each party retains autonomy and agency over their decisions; no one is compelled to accept outcomes they haven’t agreed to. Our Mediators also cannot instruct anyone to do anything or compel anyone in the process to adhere to any rules. This approach is more suitable for a legal process.
- Balanced Power Dynamics: The facilitator actively monitors and supports equity in the conversation, ensuring that no one dominates or manipulates the process.
- Transparent Communication: Honest, clear, and direct dialogue is encouraged, with space to clarify misunderstandings or misinterpretations.
- Neutral Facilitation: The therapist/mediator remains impartial, supporting both parties without taking sides or enforcing outcomes.
- Future-Focused Problem Solving: The emphasis is on finding workable solutions and creating forward momentum, rather than staying stuck in the past.
- Collaborative Mindset: Both parties must be willing to listen, reflect, and negotiate in good faith, seeking outcomes that are sustainable and fair.
- Confidentiality and Professional Boundaries: The mediator holds a safe space and maintains clear ethical boundaries to protect the process and both participants.

Ensure You Watch These Warning Signs and Keep Yourself Safe
- It is completely normal and appropriate to feel extreme sadness and a complete loss of control as the result of a bad break up or trauma. It is normal to feel hopeless and helpless. It is normal to feel you want to withdraw from life to grieve and get over your lost relationship. It is also normal to feel numb and to wonder about dying, but only if this is a passing thought.
- If you’re dwelling on morbid thoughts, you need to address them. Below are the warning signs to watch out for. Contact your doctor, family or the naked trauma team if you suspect you’re moving into dangerous territory.
- www.suicide.org advises a full list of warning signs that you can review. We have re-written this list as we believe the behaviours described should be red-flagged only if they are above and beyond what is reasonable for someone dealing with trauma.
- Please review the warning signs below carefully and ensure that when you check in with your loved ones, that they are aware of you keeping these warning signs in mind. If you are concerned that you need a different kind of mental health support, please keep yourself safe and seek this support immediately. Clients concerned about their suitability for participation should contact the team immediately to discuss appropriate support options.
